What changes when you work for yourself

In formal employment, pension contributions happen automatically. Your employer deducts your portion, adds their own contribution, and the government adds the cuota social. You accumulate contribution weeks without thinking about it.

When you become a freelancer, that automatic mechanism stops. No contributions flow into your AFORE. Your contribution week count freezes. The balance you had stops growing from new deposits. The gap between your current situation and a secure retirement begins to widen.

The good news is that the system was not designed to exclude independent workers entirely. Several mechanisms exist specifically to allow self-employed people to participate. Understanding them is the starting point.

Common situations for independent workers

Different starting points lead to different available options. Here are the most common scenarios.

This is the most common situation. You have an existing AFORE account with some balance and a contribution week history. Your challenge is maintaining momentum now that employer contributions have stopped.

What you already have: An AFORE account, accumulated contribution weeks, and possibly a significant balance if you worked formally for several years.

Options to consider (general information only):

  • Make voluntary contributions directly to your AFORE to continue growing your balance
  • Explore Modalidad 40 if you want to continue accumulating contribution weeks (time-sensitive enrollment window)
  • Register voluntarily with IMSS to access healthcare and continue accumulating contribution weeks
  • Review whether your previous contribution history qualifies you for any specific benefits under the 1973 or 1997 law

The Modalidad 40 option is particularly relevant for this group, but the enrollment window is limited. If you left formal employment recently, this may be worth researching promptly through IMSS directly.

If you have never worked under a formal employer registered with IMSS, you likely do not have an AFORE account yet and have zero contribution weeks. This is a common situation for people who started their careers as freelancers or entrepreneurs.

What this means: You do not have access to Modalidad 40 (which requires prior formal employment). However, other pathways remain open.

  • Open an AFORE account directly with any AFORE to begin voluntary savings. You do not need formal employment to open an account.
  • Register voluntarily with IMSS under the Seguro Voluntario scheme to begin accumulating contribution weeks and access healthcare

Starting from zero is more challenging, but the mechanisms are available. Opening an AFORE account and making regular voluntary contributions is something that can be done independently of any employment status.

Many workers in Mexico alternate between formal employment and freelance work throughout their careers. This creates a contribution history with gaps, which is common and manageable.

Your total contribution weeks are the sum of all weeks during which you were formally registered with IMSS, across all employment periods. Gaps between formal employment periods do not erase previously accumulated weeks.

Key considerations for this scenario:

  • Your AFORE balance reflects all contributions made during formal employment periods, plus any voluntary contributions and investment returns
  • If you are currently in a freelance period, voluntary AFORE contributions can continue growing your balance
  • If you re-enter formal employment, mandatory contributions resume automatically
  • Modalidad 40 eligibility depends on the timing relative to your most recent formal employment period

Workers with mixed histories should verify their complete contribution week record with IMSS, as it can sometimes be fragmented across multiple employer registrations and may require consolidation.

Digital professionals, remote workers, and those providing services to international clients face specific considerations. Income from foreign clients does not automatically trigger IMSS registration, so pension contributions do not happen automatically even if income is substantial.

Tax obligations for this group depend on how income is structured and declared. Workers registered under RESICO or as personas físicas con actividad empresarial have different social security access options than those under other regimes.

The key point is that earning income independently, whether from domestic or international clients, does not automatically create pension contributions. Active steps are needed to participate in the system.

Voluntary AFORE contributions remain available regardless of the source of income, as long as you have a CURP and an AFORE account. This is the most straightforward path for many digital professionals to begin building retirement savings.
